These Terms & Conditions (the "Terms") are a binding agreement between you and Thabat - Quran Memorization Review ("Thabat", "we", "us", or "our"), the operator of the Thabat mobile application, our website and their related services (together, the "Service"). Please read them carefully.
1. Acceptance of Terms
By creating an account, or by accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a minor for whom you are the parent or legal guardian, you accept these Terms on their behalf and are responsible for their use of the Service (see Section 3).
2. Definitions
- "Service" means the Thabat mobile application, its content, and any server, website or interface we provide as part of it.
- "User", "you" means any person who accesses or uses the Service.
- "Account" means the personal account you create to use the Service.
- "User Content" means any content you submit, generate or store through the Service, including:
- which portions of the Qur'an you mark as memorized;
- your quiz answers and history;
- your recitations and recitation results;
- your display name and profile bio;
- streak-pause reasons and notes;
- saved quiz settings;
- content and recitation reports, support messages, and ideas and comments.
- "Qur'anic Content" means the Arabic text of the Qur'an, muṣḥaf page layouts and fonts, and related corpus data used in the Service.
- "Subscription" means the optional paid plan described in Section 8.
- "Third-Party Services" means the external providers described in Section 10 and in the Privacy Policy.
3. Eligibility and Age
The Service is intended for users aged 13 and over. By creating an Account you confirm that you are at least 13 years old. If we learn that a person under 13 has registered, we will delete the Account.
If you are between 13 and 17 years old (or under the age of majority in your jurisdiction), you may use the Service only with the involvement and consent of a parent or legal guardian, who must agree to these Terms on your behalf and is responsible for supervising your use of the Service.
You also confirm that no applicable law bars you from using the Service.
4. Accounts and Security
To use most features you must create an Account. Sign-in is handled by our authentication provider (see Section 10). You may sign up with:
- an email address, with a password or a one-time code sent by email;
- a supported third-party sign-in (currently Google, and Apple on iPhone).
You agree to:
- provide accurate information;
- keep your sign-in details confidential;
- be responsible for all activity under your Account;
- tell us promptly if you believe your Account has been accessed without authorization;
- keep the device on which you use the Service secure.
An Account is for one person. To protect accounts, we may limit an Account to one signed-in device at a time. When you sign in on a new device, your other devices may be signed out.
5. License and Acceptable Use
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial Qur'an-memorization practice. This includes marking memorized portions, taking quizzes, reciting, tracking streaks and progress, and receiving study reminders.
You agree that you will not:
- use the Service for any unlawful purpose or in violation of these Terms;
- copy, resell, sublicense or commercially exploit the Service or its content, except as expressly permitted;
- extract, download in bulk or redistribute the muṣḥaf fonts, page layouts or other Qur'anic Content from the Service;
- reverse engineer, decompile or attempt to extract source code, except where applicable law prohibits this restriction;
- interfere with, disrupt or overload the Service, its servers or other users' accounts, or attempt to gain unauthorized access to them;
- get around plan limits, usage limits or security measures, or share an Account to do so;
- use automated means to access the Service, scrape data, or submit audio that is not your own live recitation;
- submit content that is unlawful, abusive or infringing, or that you do not have the right to submit, including recordings of other people without their permission.
6. Recitation Features
- What they do. The recitation features (the recite question and "Recite the page") use your microphone and automatic speech recognition to check your recitation word by word against the Qur'anic text.
- Their limits. Automatic checking can make mistakes. Background noise, your microphone, your connection or your reading style may cause a correct recitation to be marked wrong, or a mistake to be missed.
- How to use the result. Treat the result as a help for your own review, not as a judgement on your recitation or your tajwīd. If you think a grade is wrong, you can report it, and a scholar on our team may review it.
- Audio. How recitation audio is handled, including what is sent to speech-recognition providers and what is kept, is described in the Privacy Policy.
- Your exported recordings. Recordings you keep on your phone, and any you export or share, are your responsibility. Please treat recordings of the Qur'an with the respect they deserve.
- Usage limits. Recitation features may be subject to daily or monthly limits that depend on your plan, and may be paused or limited when capacity is low.
7. User Content and the Ideas Board
You keep your rights in your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce and process it, solely to operate, secure and improve the Service and to provide it to you. For example, we use it to:
- sync your memorization progress across your devices;
- generate your quizzes and analytics;
- grade your recitations;
- respond to your support requests and reports.
If you post an idea or comment on the in-app ideas board, you also allow us to display it to other users. Your name is not shown with it. We may edit an idea for clarity, combine similar ideas, or decide not to publish it. Posting an idea does not mean we will build it, and you are not entitled to payment or credit if we build something similar.
You are responsible for your User Content and confirm that you have the rights needed to submit it. You must not submit content that is unlawful, infringing or harmful.
The Service lets you report content you believe is incorrect or inappropriate. We, and reviewers acting on our behalf, may review, moderate, retain, remove or refuse User Content and reports, and may take action on your Account, where we reasonably believe it is necessary to enforce these Terms, comply with law, or protect users or the Service. We are not obliged to monitor User Content, but we may do so.
8. Subscriptions and Payments
The Service offers a free tier and an optional paid Subscription ("Thabat Plus") that unlocks additional features and higher limits. Where a Subscription is offered:
- it is sold and billed only through the in-app purchase systems of the Apple App Store and Google Play;
- it is processed on our behalf by our subscriptions provider (see Section 10);
- we do not collect or store your payment card details.
The following apply to Subscriptions:
- Price and trial. Pricing, billing period and any free trial are shown in the app and in the App Store or Google Play at the time of purchase. Prices may vary by country and may change, but a price change will not apply to a period you have already paid for.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends, or within the window your store requires. If you cancel during a free trial, you will not be charged.
- Managing and cancelling. You manage and cancel your Subscription through your Apple or Google account settings. Deleting the app or your Account does not cancel a store Subscription: you must cancel it in the store.
- Refunds. Refunds are handled by Apple or Google under their policies, and we generally cannot issue store refunds directly. If a refund is granted, the paid features end.
- What Plus includes. The features and limits of the free tier and of Thabat Plus are shown in the app and may change over time. If we reduce what an active paid Subscription includes in a material way, we will tell you in advance where practical, and you may cancel.
- Extra access. We may give free or extended access to some users or features, for example to early users or as a goodwill gesture. Such access may be time-limited and does not create a right to it in the future.
9. Emails and Notifications
By creating an Account you agree that we may send you service messages about your Account, payments and support requests. Practice reminders, progress summaries and news may also be sent by email and notification. You can turn these off in Settings or with the unsubscribe link, as described in the Privacy Policy.
10. Third-Party Services
The Service relies on third-party providers, who process data as described in our Privacy Policy, including:
- Clerk: authentication and identity;
- RevenueCat, together with the Apple App Store and Google Play: purchases and subscription status;
- Google: analytics, campaign measurement and push delivery;
- Resend: email delivery;
- Speech-recognition providers: checking recitations (listed in the Privacy Policy);
- Sentry: crash and error reporting;
- Expo: push notifications and app updates;
- Anthropic: an artificial-intelligence provider that helps our reviewers draft study material from Qur'anic corpus text, and helps our team review support requests and reports;
- Replit and Neon: cloud hosting and database.
Your use of these providers may also be subject to their own terms. We are not responsible for third-party services we do not control.
11. Qur'anic Content and Intellectual Property
The Arabic text of the Qur'an is not owned by anyone, and we claim no ownership of it.
The Qur'anic Content in the Service is used under licence or permission from its providers:
- Qur'an text. The Uthmani text of the Madinah Muṣḥaf (Ḥafṣ ʿan ʿĀṣim) comes from Tanzil.
- Muṣḥaf pages. The page fonts and page layout of the King Fahd Glorious Qur'an Printing Complex, provided through Quranic Universal Library (QUL).
- Word data. Word-level data comes from Quran.com.
- Fonts. The Arabic fonts Amiri Quran, Scheherazade New and Amiri are used under the SIL Open Font License.
These materials are provided inside the Service for your personal use and may not be extracted or redistributed. Questions, hints and study notes may be drafted with the help of AI. They are always generated from the established Qur'anic text and reviewed before they are shown. AI never writes or changes the Qur'anic text.
Except for Qur'anic Content and your User Content, the Service and all of its software, design, text, graphics and other materials are owned by us or our licensors and are protected by intellectual-property laws. We grant you no rights except the limited license in Section 5. You may not use our names, logos or branding without our prior written permission.
12. Availability and Changes to the Service
We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. Some features depend on connectivity, third-party services and your device.
We may:
- add, change, suspend or remove features at any time;
- offer some features first to a limited group of users, or as an early version;
- set limits on certain features, including limits that differ by plan.
We will try to give reasonable notice of material changes where practical.
13. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
The Service is a study and self-testing aid. The Qur'anic Content is drawn from established and licensed sources, and study material is reviewed before it is shown to you. Even so, we do not warrant that every question, hint, grade or study aid is free from error. The Service is not a substitute for reciting to, and learning from, a qualified teacher. We are not a religious authority and do not issue religious rulings.
14. Limitation of Liability
To the maximum extent permitted by law, we and our providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to your use of (or inability to use) the Service.
Our total liability for any claim relating to the Service will not exceed the greater of:
- the amount you paid us for the Service in the 12 months before the claim;
- 50 US dollars.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold us and our providers harmless from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from:
- your User Content;
- your use of the Service;
- your breach of these Terms or of applicable law.
16. Suspension and Termination
You may stop using the Service at any time. You can delete your Account in the app's Settings, as described in the Privacy Policy. Deletion is normally completed 30 days after you ask, and you can cancel it during that time.
We may suspend or terminate your Account, or limit your access to the Service, if we reasonably believe that you have violated these Terms or applicable law, or to protect users or the Service. Where we suspend an Account, we will, where feasible, show you the reason and give you a way to contact us to appeal through the in-app support form. A suspended Account can still contact support and delete itself.
Some obligations survive termination, including Sections 7, 11, 13, 14 and 15.
17. Apple App Store Terms
If you downloaded the app from the Apple App Store:
- Who the agreement is with. These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Your licence. Your licence is limited to using the app on Apple devices that you own or control, as permitted by the App Store's Usage Rules.
- Support and maintenance. Apple has no obligation to provide maintenance or support for the app.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
- Claims. Apple is not responsible for addressing any claims by you or any third party relating to the app, including:
- product liability claims;
- claims that the app fails to meet legal or regulatory requirements;
- consumer-protection claims.
- Intellectual property. Apple is not responsible for investigating or defending any claim that the app infringes a third party's intellectual-property rights.
- Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiaries. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the competent courts of Jordan, subject to any mandatory consumer-protection rights available to you in your country of residence.
Before starting any formal proceedings, please contact us first so we can try to resolve the matter amicably.
19. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right, that does not waive it.
- Assignment. We may transfer these Terms as part of a merger, acquisition or sale of assets. You may not transfer your rights under these Terms without our consent.
- Events beyond our control. We are not liable for delays or failures caused by events beyond our reasonable control.
20. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date and give notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, you should stop using the Service, and you may delete your Account.
21. Contact
If you have questions about these Terms, contact us at support@thabat.net or through the in-app support form.
22. Prevailing Language
These Terms are provided in English and Arabic. If the two versions conflict or differ, the English version prevails.
